AI in Philippine Legal Practice: What’s Safe, What Can Lead to Sanctions

AI can assist with organizing material, generating a first draft, and proposing research questions. It cannot establish that a case exists, that a quotation is accurate, or that an argument fits Philippine law. A lawyer remains responsible for the work submitted under the lawyer’s name.

The practical question is not whether a task uses AI. It is whether the firm can verify the output, protect the information used, and explain the final professional decision. Treat generated text as a draft requiring review rather than as an authority.

The Philippine warning is concrete

In Suazo v. Tri Megaforce Security Services Corporation, G.R. No. 276106, the Supreme Court addressed invented or misrepresented case law and instituted a separate disciplinary complaint for IBP proceedings. The referral should not be described as a final disciplinary penalty in that separate case.

In a September 2026 address, Senior Associate Justice Leonen also warned against uncritical AI use, including the risk that a real citation may not support the proposition attached to it. Checking that a case exists is only the beginning.

Classify tasks by verification and data exposure

This is a suggested firm policy framework, not a statutory classification of permitted and prohibited AI tasks. No tool or use case is declared unconditionally safe.

TaskSuggested control
Formatting or neutral outlineReview for omissions and preserve the source
Summary of supplied recordsCheck every material statement against the actual record
Research suggestionsRetrieve and read the primary authority independently
Draft argument or contract clauseQualified lawyer reviews legal fit and client instructions
Deadline extractionVerify the source date, service rule, period, and calculation
Confidential file uploadReview authorization, vendor terms, access, and retention first

Use a citation verification checklist

For a document summary, use the same discipline with record references. A fluent chronology can silently omit a date or merge two people. Keep page references and flag uncertainty rather than asking the system to fill gaps confidently.

  • •Retrieve the full authority from an appropriate primary source.
  • •Match case name, docket number, date, court, and cited passage.
  • •Read the context and confirm that the proposition follows.
  • •Check whether the passage is a holding, quotation, argument, or separate opinion.
  • •Review later treatment and applicable amendments where relevant.
  • •Replace unsupported propositions rather than merely removing quotation marks.
  • •Record the source used and the lawyer who approved reliance.

Protect client information before prompting

Decide which systems the firm authorizes and what data each may receive. Examine vendor access, retention, training use, subprocessors, and export or deletion arrangements. Remove unnecessary identifiers when an anonymized example will do.

Do not assume a paid account, a privacy setting, or an NPC registration label answers every confidentiality question. Apply the firm’s data-protection and professional-duty analysis to the actual product and workflow.

Keep a useful approval record

For material work, record the task, source materials, important limitations, verification steps, and final reviewer. Retain only what is justified by the firm’s policies and obligations; indiscriminate prompt logging can itself expose confidential information.

Start with a small pilot such as organizing fictional records. Test deliberate errors, missing pages, and conflicting dates. Measure whether staff catch the errors before allowing the workflow into more consequential work. Revisit the policy when tools or rules change.

Frequently asked questions

Is using AI itself sanctionable for Philippine lawyers?

This article does not identify a blanket prohibition. Professional exposure depends on the conduct, applicable rules, and facts, including accuracy, candor, confidentiality, and competent review.

Is an existing case citation enough to verify an AI answer?

No. Read the decision and check that the actual passage supports the proposition, fits the procedural context, and remains applicable.
